1. Agreement to Terms

By accessing and using the SearchByVideo service, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Subject to these Terms and your chosen plan, SearchByVideo grants you a limited, non-exclusive, non-transferable license to access and use the service — including for your commercial projects — to upload, analyze, and search your own video content. You retain ownership of your videos (see the Materials and Content section). Under this license you may not:

Resell, sublicense, redistribute, or "mirror" the service itself on another server
Copy, modify, or create derivative works of the SearchByVideo software or website, except as needed to use the service normally
Attempt to decompile or reverse engineer any software contained in the service
Remove any copyright or other proprietary notices from the service
Upload content you do not have the rights to, or use the service in violation of applicable law or these Terms

3. Disclaimer

The materials on SearchByVideo website are provided on an 'as is' basis. SearchByVideo makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

In no event shall SearchByVideo or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on SearchByVideo website, even if SearchByVideo or an authorized representative has been notified orally or in writing of the possibility of such damage.

5. Accuracy of Materials

The materials appearing on the SearchByVideo website could include technical, typographical, or photographic errors. SearchByVideo does not warrant that any of the materials on our website are accurate, complete, or current. SearchByVideo may make changes to the materials contained on its website at any time without notice.

6. Materials and Content

Your videos remain your property. By uploading videos to SearchByVideo, you grant us a limited license to process and analyze your videos for the sole purpose of providing the SearchByVideo service. Videos are not stored permanently on our servers and are deleted after processing.

7. Billing, Subscriptions and Refunds

SearchByVideo offers a Free plan and paid subscription plans (billed monthly or annually) that grant a monthly allotment of credits. Payments are processed by our third-party Merchants of Record, Creem (creem.io) and/or Waffo (waffo.ai), which handle billing and tax collection on our behalf. Refund rules: (a) we offer a 7-day money-back guarantee on your initial subscription purchase — contact us within 7 days of that purchase for a full refund; (b) duplicate or erroneous charges are refunded in full; (c) after the 7-day window, payments for a billing period that has already started are non-refundable and partial periods are not pro-rated, except where required by law or where we terminate your account without cause; (d) credits granted in a billing cycle are consumed as you use the service, do not carry over, and are not separately refundable; and (e) statutory withdrawal rights (such as the EU/UK 14-day cooling-off period) are preserved for your first purchase and no longer apply once you begin using the service. To request a refund, email support@searchbyvideo.net with your account email and the reason for your request.

8. Term and Termination

These Terms remain in effect for as long as you use the service. If you materially violate these Terms, or use the service in a fraudulent, abusive, or unlawful manner, we may, at our sole discretion and with or without prior notice: suspend your access temporarily or indefinitely; terminate your account and revoke your license to use the service; forfeit any remaining credits and unused paid balance in your account without refund; and remove content that violates these Terms. If we terminate or suspend your account because of your breach, you are not entitled to any refund of fees already paid or of forfeited credits. If we discontinue the service for reasons not attributable to your breach, we will refund the pro-rated, unused portion of any prepaid subscription. You may stop using the service and delete your account at any time from your account settings or by contacting support@searchbyvideo.net.

In no case shall SearchByVideo, its suppliers, or other related parties be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the SearchByVideo service, even if SearchByVideo or an authorized representative has been notified orally or in writing of the possibility of such damage.

SearchByVideo has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by SearchByVideo of the site. Use of any such linked website is at the user's own risk.

SearchByVideo may revise these terms of service for our website at any time without notice. By using this website, you are agreeing to be bound by the then current version of these terms of service.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the People’s Republic of China, without regard to its conflict of law provisions. You agree to submit to the jurisdiction of the competent courts located in China for the resolution of any dispute arising from or relating to these Terms or the SearchByVideo service.
